These Terms of Service (the “Terms”) govern your access to and use of troianiscustoms.com (the “Site”) and any automotive services provided by Troiani's Customs (“Company,” “we,” “us,” or “our”), including mobile and in-shop services (collectively, the “Services”).
By accessing the Site, requesting a quote, booking, or receiving any Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or our Services.

2. Definitions
For purposes of these Terms:
- “Customer,” “you,” or “your” means the person or entity using the Site, requesting a quote, booking Services, or paying for Services.
- “Vehicle” means any car, truck, SUV, motorcycle, or other vehicle we work on.
- “Appointment” means any scheduled date/time for us to perform Services.
- “Specialty Services” include, without limitation, ceramic coatings, paint correction, tint, wraps, PPF, or paint-related work.
3. Eligibility
By using the Site or Services, you represent and warrant that:
- You are at least 18 years old and capable of entering a binding contract; or
- You are acting on behalf of an organization and are authorized to bind that organization; and
- You are the owner of the Vehicle or have full authority from the owner to authorize the Services.
If any of these are not true, you are not authorized to use the Services.
4. Modifications to Site, Services, and Terms
- We may modify, suspend, or discontinue all or part of the Site or Services at any time without notice.
- We may update these Terms at any time. The “Last updated” date will reflect the latest version.
- Your continued use of the Site or Services after changes are posted constitutes acceptance of the updated Terms.
5. Description of Services (Non-Binding)
We provide automotive appearance and related services, which may include but are not limited to:
- Mobile and in-shop detailing
- Interior and exterior cleaning
- Paint decontamination, polishing, and correction
- Ceramic and other protective coatings
- Window tinting
- Vinyl wraps and other cosmetic modifications
- Other related services as listed on the Site or quoted to you
Service descriptions, photos, and sample results on the Site are illustrative only and do not constitute a guarantee of any specific outcome.
6. Quotes, Inspections, and Additional Charges
6.1 Estimates Only
- Prices provided by phone, text, DM, email, web form, or online booking are estimates only.
- Final pricing may change after physical inspection of the Vehicle.
6.2 Condition-Based Adjustments
You agree that pricing may increase if, upon inspection, we determine the Vehicle has:
- Excessive dirt, salt, or road grime
- Heavy pet hair, sand, glitter, bodily fluids, mold/mildew, or other contaminants
- Severe staining or odor
- Excessive paint defects, overspray, or contamination
- Any condition that significantly increases time, materials, or risk
We will make reasonable efforts to discuss adjusted pricing with you before proceeding. If you decline, we may cancel the Appointment and apply any applicable cancellation or minimum service fee.
6.3 Minimum Service Charge
We may have a minimum service charge for any Appointment. This will be disclosed at booking or upon arrival.
7. Booking, Deposits, Payments, and Chargebacks
7.1 Booking
You may book through:
- Our Site’s booking system
- Phone, text, email, or messaging platforms
- Third-party platforms (e.g., Google, social media booking tools)
All bookings are subject to our acceptance and availability.
7.2 Deposits
- Certain services or time blocks may require a non-refundable deposit.
- Deposits are generally applied toward your final invoice.
- If you cancel or fail to show within the cancellation window, deposits may be forfeited as a cancellation/no-show fee.
7.3 Payment Terms
- Payment is due immediately upon completion of Services unless otherwise agreed in writing.
- We accept payment methods listed on the Site or communicated to you (e.g., cash, card, digital payments).
- If your card is declined or payment fails, you remain responsible for the balance.
7.4 Chargebacks and Collections
- You agree not to initiate chargebacks for Services performed in accordance with these Terms.
- If you initiate a chargeback, you remain responsible for the full amount plus any fees we incur (bank fees, processing fees, collection costs, and reasonable attorneys’ fees).
- We reserve all lawful remedies to recover unpaid balances, including collections and legal action.
8. Cancellations, Rescheduling, and No-Shows
8.1 Customer Cancellations
- If you need to cancel, you must notify us at least 24 hours before your Appointment.
- Cancellations within 24 hours may result in:
- Forfeiture of deposit; and/or
- A cancellation fee of $40.
8.2 Rescheduling
- You may request to reschedule once without penalty if requested more than 24 hours before the Appointment and subject to availability.
- Reschedules requested within 24 hours may be treated as a cancellation and require a new deposit.
8.3 No-Shows and Access Issues
- If we arrive and you or the Vehicle are not available, you are unreachable, or we do not have adequate access or permission to perform the work within 15 minutes, this may be deemed a no-show.
- No-shows may result in deposit forfeiture and/or a no-show fee of $50.
- If we cannot safely access the Vehicle or workspace (tight parking, unsafe neighborhood, severe weather, etc.), we may cancel the Appointment and apply a cancellation fee.
9. Customer Responsibilities: Vehicle Prep & Personal Items
You are responsible for:
- Removing all personal items and valuables from the Vehicle, including but not limited to:
- Cash, cards, IDs, documents
- Electronics, jewelry, firearms, tools
- Child seats, accessories, and removable organizers (unless we agree otherwise)
- Disclosing any known hazards or conditions, such as:
- Biohazards (blood, vomit, feces, urine)
- Needles, drugs, or paraphernalia
- Mold, rodents, or other health hazards
- Ensuring we have legal permission to work on the Vehicle.
We are not responsible for loss, theft, or damage to personal items left inside the Vehicle, whether we were aware of them or not.
10. Condition of Vehicle & Risk of Damage
10.1 Pre-Existing Damage
Many Vehicles have pre-existing defects such as:
- Scratches, swirls, oxidation, rock chips, dents
- Thin or failing clear coat
- Faded or brittle plastics
- Damaged or loose badges, trim, emblems
Cleaning and detailing often make such defects more visible. You acknowledge:
- We are not responsible for pre-existing damage.
- We may document the condition (including photos/videos) before and after service.
10.2 Aging, Fragile, and Aftermarket Components
We are not responsible for damage to:
- Old, brittle, or previously repaired clear coat or paint
- Peeling paint or clear coat that fails during normal cleaning or polishing
- Aftermarket parts, wraps, or tint applied by others
- Loose or poorly installed trim, badges, or clips
10.3 Mechanical & Electrical Issues
We do not diagnose or repair mechanical or electrical systems. You acknowledge that:
- We may move and operate your Vehicle (start, park, reposition) as needed.
- We are not responsible for mechanical, electrical, or sensor issues that fail or present during or after our Services, including:
- Battery failure, alternator issues
- Check-engine lights, warning lights
- Power seat, window, or lock malfunctions
- Exposure to moisture during normal cleaning may reveal pre-existing sealing or electrical issues.
11. Specialty Services: Coatings, Paint Correction, Tint, Wraps, etc.
11.1 Paint Correction
Paint correction and polishing:
- Reduce the visibility of defects but rarely achieve 100% defect removal, especially on older or softer paint.
- Involve a calculated removal of clear coat; too much removal can cause long-term damage.
- Results vary depending on paint system, prior damage, and condition.
We do not guarantee full scratch removal or show-car finish unless explicitly promised in writing.
11.2 Ceramic and Other Coatings
Ceramic and similar coatings:
- Provide enhanced gloss and protection, but do not make the Vehicle maintenance-free or damage-proof.
- Have performance and longevity heavily dependent on your maintenance practices (proper washing, no harsh chemicals, etc.) and storage conditions.
You acknowledge:
- Failure to follow our care instructions (provided verbally, in writing, or on the Site) may void any implied expectations of durability.
- Coatings do not guarantee resistance to rock chips, deep scratches, water spots, or all chemical stains.
11.3 Window Tint
Window tint:
- May contain minor installation imperfections (e.g., small dust specs, slight edge variations) within industry-accepted tolerances.
- Requires a cure period where small bubbles or haziness may appear but usually resolve.
- May be subject to local laws. You are responsible for ensuring your tint complies with applicable tint laws. We are not responsible for tickets, fines, or required removals.
11.4 Wraps / PPF / Graphics
Graphics, wraps, or PPF:
- May not perfectly cover every edge or contour.
- May lift or fail prematurely if underlying paint or prep conditions are poor.
- Removal can damage weak or repainted surfaces; we are not liable for paint damage during removal when reasonable care is used.
12. Health & Safety
We reserve the right to:
- Refuse or stop work if the Vehicle contains hazardous materials, pests, or conditions that pose a risk to health or safety (biohazards, drugs, weapons, aggressive animals, etc.).
- Charge additional fees for biohazard or extreme conditions cleanup when we agree to proceed.
13. Satisfaction, Re-Work, and Refunds
- We aim to deliver high-quality results. If you are dissatisfied, you must notify us before we leave the Vehicle or within 48 hours with supporting photos.
- If we determine in our discretion that we did not perform the Service as agreed, we may offer:
- Reasonable re-work or touch-up; or
- A partial credit toward future services.
- Refunds are generally not offered once Services are completed, except where required by law.
14. Photos, Videos, and Marketing Use
We may take photos and/or videos of your Vehicle:
- For internal documentation, quality control, and training; and
- For marketing via our Site, social media, ads, and other channels.
By using our Services, you grant us a non-exclusive, worldwide, royalty-free license to use images/videos of your Vehicle for these purposes, provided that we do not publicly display your license plate or other personal identifiers without masking or your consent.
If you do not want your Vehicle used in marketing materials, you must inform us in writing before the Service begins.
15. Site Use, Accounts, and Prohibited Conduct
If you create an account on the Site, you are responsible for:
- Maintaining confidentiality of your login credentials; and
- All activities under your account.
You agree not to:
- Use the Site for any unlawful or unauthorized purpose.
- Attempt to breach or bypass security measures.
- Interfere with the operation of the Site (e.g., malware, scraping, excessive requests).
- Impersonate any person or entity or misrepresent your affiliation.
We may suspend or terminate your access to the Site or Services at any time for violation of these Terms or applicable law.
16. User Content, Reviews, and Feedback
If you submit reviews, testimonials, photos, videos, or other content (“User Content”):
- You grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, display, and distribute such User Content in connection with our business.
- You represent that you own or have rights to the User Content and that it does not infringe any third-party rights.
- We may remove or refuse to display any User Content at our discretion.
17. Third-Party Links and Tools
The Site may contain links to third-party websites, apps, or services not owned or controlled by us.
- We do not endorse or assume responsibility for any third-party content, policies, or practices.
- Your use of third-party services is at your own risk and subject to their terms and policies.
18. Privacy
Your use of the Site may involve submitting personal information. Our collection and use of personal information are described in our Privacy Policy, which is incorporated by reference into these Terms.
19. Force Majeure
We are not liable for any failure or delay in performance of our obligations caused by events beyond our reasonable control, including but not limited to:
- Severe weather, natural disasters
- Power outages, internet failures
- Labor disputes, strikes
- Government actions or restrictions
- Accidents, illness, or emergencies
In such cases, we may reschedule or cancel Appointments without liability, other than returning any deposits where required by law.
20. Warranty Disclaimer
To the fullest extent permitted by law:
- The Site and Services are provided on an “AS IS” and “AS AVAILABLE” basis.
- We expressly disclaim all warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that the Site will be uninterrupted, secure, error-free, or free of viruses or harmful components.
21. Limitation of Liability
To the fullest extent permitted by law:
- We, our owners, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of use, lost profits, or loss of data, arising out of or related to the Site or Services.
- Our total aggregate liability for any claim arising out of or relating to the Site or Services shall not exceed the amount actually paid by you to us for the specific Service giving rise to the claim.
- You agree that any claim or cause of action arising out of these Terms, the Site, or Services must be brought within one (1) year after the cause of action accrues, or be permanently barred.
Some jurisdictions do not allow certain limitations, so some of the above limitations may not apply to you; in that case, our liability shall be limited to the minimum extent allowed by law.
22. Indemnification
You agree to indemnify, defend, and hold harmless Troiani’s Customs, its owners, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Site or Services;
- Your breach of these Terms;
- Your violation of any law or third-party rights;
- Any misrepresentation regarding your authority to authorize Services on a Vehicle.
23. Governing Law, Venue, and Dispute Resolution
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law principles.
23.1 Venue
Subject to any arbitration provision you may choose to add, any lawsuit arising out of or relating to these Terms, the Site, or Services shall be brought exclusively in the state or federal courts located in DuPage County, Illinois, and you consent to the personal jurisdiction of such courts.

24. Severability, Waiver, and Assignment
- If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
- You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
25. Entire Agreement
These Terms, together with any written service-specific agreements, estimates, or policies referenced herein (including our Privacy Policy), constitute the entire agreement between you and us regarding the Site and Services and supersede all prior or contemporaneous communications.
